1. Introduction and Acceptance of Terms

Welcome to Veteran Medical Evidence (“VME,” “Company,” “we,” “us,” or “our”).

These Terms and Conditions (“Terms”) govern your access to and use of VeteranMedicalEvidence.com, including its associated websites, secure application, online portals, features, and related services (collectively, the “Platform”).

By accessing or using the Platform, you acknowledge that you have read and agree to these Terms. If you do not agree, please discontinue use of the Platform.

Additional terms, agreements, authorizations, or policies may apply when you purchase services or submit medical information.

2. About Veteran Medical Evidence

Veteran Medical Evidence provides Veterans with access to independent medical evidence services, which may include Nexus Letters, Medical Record Reviews, independent medical opinions, and other professional medical documentation services as offered through the Platform.

Services are subject to availability, provider review, applicable professional standards, and the scope of the service purchased.

Veteran Medical Evidence is not a government agency and is not affiliated with, endorsed by, or sponsored by the United States Department of Veterans Affairs (“VA”).

Important limitations:

• Veteran Medical Evidence is not a law firm, attorney, or VA-accredited representative.

• We do not provide legal advice or represent Veterans before the VA.

• We do not file, prosecute, or manage VA disability claims on behalf of Veterans.

• Medical findings and opinions are based on independent professional judgment and the information available for review.

• Purchasing a service does not guarantee that a particular medical conclusion or document will be issued.

• No service guarantees service connection, a disability rating, an increase in benefits, or any other VA claim outcome.

Only the Department of Veterans Affairs determines VA disability benefits and claim outcomes.

3. Eligibility and User Responsibilities

By using the Platform, you represent that you are at least 18 years old or otherwise legally authorized to enter into a binding agreement.

You agree to provide accurate, complete, and current information when registering for an account, submitting requests, or purchasing services.

You are responsible for ensuring that any information or documentation you submit is accurate to the best of your knowledge and that you are authorized to provide it.

You agree not to:

• Submit false, fraudulent, or misleading information.

• Upload records or materials without the necessary authorization.

• Use the Platform for unlawful purposes.

• Attempt to gain unauthorized access to accounts, systems, or data.

I• nterfere with the operation or security of the Platform.

• Misrepresent your identity or relationship to another individual.

We reserve the right to restrict or suspend access when reasonably necessary to protect the Platform, its users, or the integrity of our services.

4. Account Registration and Security

Certain services require the creation of a secure Veteran Medical Evidence portal account.

Your account may be used to submit service requests, provide documentation, communicate with authorized staff, review order information, and access available documents.

The VME application operates with safeguards designed to support compliance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and applicable implementing regulations.

You are responsible for maintaining the confidentiality of your login credentials and notifying Veteran Medical Evidence promptly if you suspect unauthorized access to your account.

We may take reasonable security measures, including temporarily restricting account access, when suspicious or unauthorized activity is identified.

5. Service Orders and Independent Medical Review

Services available through the Platform may require payment, supporting medical records, questionnaires, authorizations, or other information before a request can be evaluated or completed.

The submission or purchase of a service does not guarantee the issuance of a favorable medical opinion, Nexus Letter, or other requested documentation.

Medical professionals exercise independent professional judgment when reviewing the available information. Their findings cannot be predetermined or guaranteed by Veteran Medical Evidence.

Additional documentation may be requested when necessary to complete a review. Service timelines may vary depending on the scope of the request, record completeness, and provider availability.

Any service-specific terms, payment obligations, cancellation conditions, or refund provisions presented during the ordering process will apply to the applicable purchase, subject to governing law.

6. Medical and Legal Disclaimers

Information published on the Platform is provided for general informational and educational purposes and should not be considered individualized medical or legal advice.

Website content does not establish a healthcare provider-patient relationship.

Where a service involves a licensed medical professional, the nature and scope of any professional relationship will depend on the service provided and applicable law.

Veteran Medical Evidence does not guarantee that documentation obtained through its services will be accepted by the VA or result in a favorable benefits determination.

Nothing on the Platform should replace appropriate medical care, diagnosis, or treatment from a qualified healthcare professional.

The Platform is not intended for medical emergencies.

7. Privacy, HIPAA, and Medical Information

Veteran Medical Evidence recognizes the importance of protecting personal information and sensitive medical documentation submitted through its Platform.

The VME application is designed and operated with administrative, technical, and physical safeguards intended to support HIPAA compliance, including the protection of sensitive medical information.

Where HIPAA applies to Veteran Medical Evidence or its service providers, protected health information will be handled in accordance with applicable HIPAA requirements.

Personal and medical information submitted through the Platform may be collected, stored, accessed, used, and disclosed as reasonably necessary to evaluate service requests, coordinate independent medical reviews, communicate with authorized providers, and deliver purchased services, subject to applicable law and required authorizations.

Access to sensitive information is limited according to applicable operational responsibilities and security controls.

Our collection, use, retention, and disclosure of personal information are further addressed in our Privacy Policy and any applicable privacy notices or authorizations.

By using the Platform, you acknowledge that our Privacy Policy has been made available to you.

Nothing in these Terms limits rights afforded to individuals under applicable privacy laws.

8. Cookies and Website Technologies

The Platform may use cookies and similar technologies to support essential website functions, maintain preferences, improve functionality, and understand website usage.

Certain third-party service providers may also use technologies in connection with authorized Platform operations.

Where required by applicable law, we will request consent or provide appropriate choices regarding nonessential cookies and tracking technologies.

Cookies and tracking technologies are subject to applicable privacy requirements, including restrictions concerning sensitive medical information.

Additional information is available in our Privacy Policy.

9. Intellectual Property

Unless otherwise stated, all content available through the Platform, including text, graphics, logos, icons, images, videos, designs, software, and other materials, is owned by or licensed to Veteran Medical Evidence and protected under applicable intellectual property laws.

You may access and use publicly available website content for lawful personal, noncommercial purposes.

Without prior written authorization, you may not:

• Republish or commercially distribute protected Platform content.

• Sell, rent, or sublicense our materials.

• Reproduce or modify protected materials for unauthorized commercial use.

• Use our branding, logos, or trademarks in a manner that implies an unauthorized affiliation or endorsement.

These restrictions do not limit any rights you may have under applicable law or your ownership or authorized use of personal documents.

10. User-Submitted Content and Medical Documentation

You retain any ownership rights you have in materials you lawfully submit to the Platform, including personal records and other documentation.

By submitting materials, you authorize Veteran Medical Evidence and appropriate service providers to access, process, and use those materials as reasonably necessary to provide the services you request, subject to applicable privacy requirements and any additional authorizations required by law.

You represent that you have the necessary rights and permissions to submit these materials.

We do not claim ownership of your personal medical records solely because they are submitted through the Platform.

Medical records and other sensitive information will be managed in accordance with applicable privacy and security requirements.

Nothing in these Terms replaces any HIPAA authorization or other consent that may be legally required for a specific use or disclosure of medical information.

11. Reviews and User Feedback

Users may have opportunities to submit reviews, ratings, testimonials, or other feedback regarding their experiences.

Any submitted feedback must reflect genuine experiences and must not contain fraudulent, knowingly false, threatening, harassing, discriminatory, or otherwise unlawful content.

We reserve the right to moderate or remove content that violates these standards, applicable law, or the rights of others.

We do not require reviews to be positive and do not prohibit users from sharing truthful opinions or experiences.

If you submit content for publication, you grant Veteran Medical Evidence a nonexclusive, royalty-free license to display and reproduce that content for the purposes for which it was submitted, subject to applicable law and privacy requirements.

Separate authorization may be required before identifiable testimonials or sensitive personal information are used in promotional materials.

Reviews and testimonials reflect individual experiences and do not guarantee similar results for other users.

12. Third-Party Websites and Links

The Platform may contain links to third-party websites, resources, or services.

These links are provided for convenience or informational purposes. Veteran Medical Evidence does not control and is not responsible for the content, security practices, or privacy policies of independent third-party websites.

The inclusion of a link does not necessarily imply endorsement or affiliation.

You may link to publicly accessible pages of our website, provided the link is lawful, accurate, and does not falsely suggest sponsorship, partnership, or endorsement by Veteran Medical Evidence.

You may not frame or otherwise present our website in a misleading manner without prior written authorization.

13. Platform Availability and Disclaimer of Warranties

We strive to maintain an accessible, reliable, and secure Platform. However, we cannot guarantee uninterrupted access or that the Platform will always be free from technical errors, interruptions, or security vulnerabilities.

To the fullest extent permitted by applicable law, the Platform and general website content are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in this section is intended to disclaim obligations or warranties that cannot lawfully be excluded, including applicable privacy, data security, or professional standards of care.

14. Limitation of Liability

To the fullest extent permitted by Delaware law and other applicable law, Veteran Medical Evidence will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Platform, including loss of data, interrupted access, or business disruption.

To the extent legally permissible, the total liability of Veteran Medical Evidence for claims arising solely from general website use will not exceed the greater of:

• The amount paid to Veteran Medical Evidence in connection with the applicable website-related claim during the preceding six months; or

• $100.

This limitation does not apply where prohibited by law and does not limit liability for conduct or obligations that cannot legally be excluded or restricted.

Liability related to purchased professional services may be subject to additional service agreements and applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Veteran Medical Evidence and its officers, employees, contractors, and representatives from third-party claims, damages, liabilities, and reasonable expenses, including attorneys’ fees, arising from:

• Your unlawful use of the Platform.

• Your material violation of these Terms.

• Your infringement of another party's intellectual property or legal rights.

• Your submission of information or materials that you are not authorized to provide.

This provision does not require you to indemnify Veteran Medical Evidence for its own unlawful conduct or negligence where such indemnification is prohibited by law.

16. Dispute Resolution

If a dispute arises regarding use of the Platform, we encourage you to contact Veteran Medical Evidence first so that we may attempt to resolve the matter informally.

Any dispute resolution procedures applicable to purchased services may be addressed in the corresponding service agreement.

Disputes that cannot be resolved informally will be handled in accordance with Delaware law, applicable federal law, and any separately agreed, legally enforceable dispute resolution provisions.

Nothing in these Terms is intended to restrict rights or remedies that cannot legally be waived.

17. Changes to These Terms

Veteran Medical Evidence may update these Terms periodically to reflect changes in Platform functionality, business practices, services, or applicable legal requirements.

Updated Terms will be published on the Platform with a revised effective date.

Where required by law, we will provide additional notice or obtain consent before material changes become effective.

Continued use of the Platform after revised Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.

18. Assignment

Veteran Medical Evidence may assign or transfer its rights and obligations under these Terms in connection with a lawful business transaction, restructuring, or transfer of operations, subject to applicable law.

You may not assign your rights or obligations under these Terms without our prior written consent, except where prohibited by law.

19. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or severed to the extent necessary, and the remaining provisions will continue in effect.

20. Entire Agreement

These Terms, together with the Privacy Policy and any applicable service-specific agreements, represent the agreement governing your use of the Platform.

Separate agreements governing purchased services, provider authorizations, or other transactions may contain additional provisions.

If a conflict arises between these Terms and a separately executed agreement concerning a specific service, the terms of that agreement will control with respect to that service, to the extent permitted by law.

21. Governing Law and Jurisdiction

These Terms and any dispute arising from your use of the Veteran Medical Evidence Platform shall be governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, except where applicable federal law or mandatory consumer protection laws require otherwise.

Subject to any applicable and enforceable dispute resolution agreement, disputes arising under these Terms shall be brought before a court of competent jurisdiction in Delaware, unless applicable law requires otherwise.

Nothing in these Terms limits any rights or protections that cannot legally be waived.
